SUPREME COURT JUDGEMENT IN NAWAZ SHARIF CASE

 

AUGUST 23, 2007

 

 

Fundamental Rights enshrined in the Constitution are always considered paramount and cannot be curtailed, usurped or infringed by any legislative device or executive measurement. However, it is subject to any reasonable restriction that may be imposed by law in the public interest. 

 

No such reasonable restriction could be pointed out by the learned Attorney General for Pakistan imposed on the petitioners by law in the public interest. 

 

The undertaking cannot be equated to that of legal restrictions imposed in the public interest.

 

Article 9 of the Universal Declaration of Human Rights declares: No one shall be subjected to arbitrary arrest, detention or exile.

 

Article 13 states: Everyone has the right to leave any country, including his own, and to return to his country.

 

The Human Rights Declaration itself draws its inspiration in this regard from the Magna Carta, which, as early as 1215, proclaimed: "No man shall be outlawed or exiled Except by the lawful judgment of his equals or by the law of the land.

 

International Covenant on Civil and Political Rights (ICCPR): Article 12(4) states that no one shall be arbitrarily deprived of the right to enter his own country.

 

 

Notwithstanding national and international efforts to outlaw political exile, the practice persists in authoritarian and politically under-developed societies as an undesirable legacy of ancient times.

 

Had this undertaking not been in the field the position would have been different and sentence awarded in various cases would remain intact. The petitioners got remission/pardon on the basis of such undertaking hence it cannot be kept out of consideration.

 

 

Journey to Saudi Arabia cannot be termed as "forced exile" which was never challenged for a couple of years as the petitioners were aware regarding the undertaking which culminated to their release from jail.

 

They were fully aware about it and by no stretch of imagination it can be termed as "forced exile".

Every citizen has undeniable right vested in him as conferred under Article 15 of the Constitution to go abroad and return back to Pakistan without any hindrance and restrain.

 

 

 

Any invasion upon the rights of citizens by anybody no matter whether by a private individual or by a public official or body, must be justified with reference to some law of the country.

 

Functionaries of State are to function strictly within the sphere allotted to them and in accordance with law

 

An action of an Authority admitted to be derogatory to law and Constitution is liable to be struck down."

 

It is declared that Mian Muhammad Nawaz Sharif and Mian Muhammad Shahbaz Sharif, under Article 15 of the Constitution of Islamic Republic of Pakistan, 1973 have an inalienable right to enter and remain in country, as citizens of Pakistan.

 

Their return/entry into country shall not be restrained, hampered or obstructed by the Federal or Provincial Government Agencies, in any manner

TEHRAN, Oct 9, 2007 (AFP) -

Iran and Pakistan have agreed to periodic revision of gas prices as part of a pipeline deal to to carry Iranian gas via Pakistan to India, the Isna news agency said on Tuesday, quoting the local export company.

"The two parties have agreed that each side submit its demands for gas price revision to the other side every three years, taking into account the situation on the international market," said a statement from the National Society for Gas Exports from Iran.

The two countries have also agreed on other terms, particularly dealing with "situations of force majeure and the law governing the agreement."

According to the statement quoted by Isna, the Indian side -- opposed to a price review system -- may take part in future talks.

Late in September, Hojatollah Ganimifard, Iran's deputy minister in charge of the project, said Iran and Pakistan had reached an agreement, in the absence of India, on the pipeline.

He added that the two countries should meet in Pakistan in mid-October to approve a final version of the agreement, with a probable signing of the accord at the end of the month.

Talks on the 7.4 billion dollar project to supply gas to India through a 2,600 kilometre (1,615 mile) pipeline began in 1994 but suffered from tensions between India and Pakistan.

Talks resumed early in 2004 along with peace moves between India and Pakistan but have dragged because of New Delhi's opposition to periodic price reviews.

India has also come under US pressure not to be part of the project in what is seen as Washington's desire to punish Iran for its refusal to bow to demands to suspend its nuclear programme.

Beneficiaries of National Reconciliation Ordinance

Who will benefit?

ISLAMABAD: Around 20 politicians, coupled with dozens of former bureaucrats, would be the immediate beneficiaries of the National Reconciliation Ordinance (NRO), majority of them said to be close associates of Benazir Bhutto or the front men of her spouse, Asif Ali Zardari. Besides Ms Bhutto and Asif Ali Zardari, the NRO is also set to bring peace in the lives of those involved in corrupt practices during the regime of the former couple. In the politicians' list of prospective beneficiaries, the names of PPP Punjab secretary general Jehangir Badr, Ch Ahmad Mukhtar and Zardari's front men like Agha Siraj Durrani are prominent. Former bureaucrats with tainted reputation like Salman Farooqi and his Personal Staff Officer Siraj Shams-ud-Din, Shahid Hassan, former finance secretary Talat Javed, Rehman Malik, former NBP president M B Abbasi and Wajid Shams-ul-Hassan, will also turn out to be the beneficiaries of this ordinance – the easiest way to turn black money into white. Besides the sitting Interior Minister and former confidant of Ms Bhutto, Aftab Sherpao, Water and Power Minister Liaqat Jatoi and the speaker of Sindh Assembly Muzaffar Hussain Shah are at the top of the list of prospective beneficiaries from the government side. Although, those having no links with the PPP would also be enjoying immunity, the PPP leaders are said to be the biggest beneficiaries of this amnesty to be announced through the promulgation of an ordinance. There is a long list of politicians and bureaucrats who allegedly amassed wealth by all fair and foul means during Ms Bhutto's regime and who would go scot-free after the promulgation of this ordinance. The likes of Agha Siraj Durrani, former provincial minister from Sindh and close confidant of Zardari, is among the prospective beneficiaries. He was wanted in different corruption cases filed against Zardari. Nowadays, he is a frequent visitor of the alleged Mr 10 percent, Asif Ali Zardari, presently living in the US. A former provincial law minister from Sindh, Pir Mazhar-ul-Haq, has also a corruption case pending in the accountability court and is presently said to be on bail. Although, he himself could not make way into the assembly, his daughter Marvi Mazhar is a PPP MPA in the Sindh Assembly. Former PPP chief minister Abdullah Shah, who was wanted in corruption cases, died several months ago. There are two confidants of Pir Pagaro who would also be the beneficiaries of this amnesty. They are former CM Sindh and presently the speaker of the provincial assembly, Muzaffar Hussain Shah, and former provincial minister Islam-ud-Din Sheikh. There were around 26 corruption cases against Sheikh. He had entered into a plea bargain with the NAB in a number of cases. One or two cases against Sheikh are still pending and he is on bail at the moment. PML-N leader Mian Shahbaz Sharif would also be a beneficiary of this amnesty as there are three corruption references against him pending with the accountability court in Rawalpindi.

Musharraf appoints General Kiani as next COAS

Rawalpindi October 2:      Lieutenant General Tariq Majid, has been promoted General and appointed as Chairman Joint Chiefs of Staff Committee. He will assume the appointment with effect from 8 October 2007. Lieutenant General Ashfaq Parvez Kayani has been promoted General and appointed as Vice Chief of Army Staff who shall assume charge of Chief of Army Staff on vacation of that office. He will assume the appointment of Vice Chief of Army Staff with effect from 8 October 2007.
            Lieutenant General Tariq Majid was born in Aug 1950 and commissioned in Baloch Regiment in Apr 1971. He is graduate of Command and Staff College, Quetta, Malaysian Armed Forces Staff College, Kuala Lumpur, Asia Pacific College of Security Studies, Hawaii, USA, National Defence College, Pakistan and holds MSc degree in War Studies.
            During his military career, he has commanded Light Anti Tank Unit and an Infantry Battalion, two Infantry Brigades, Infantry Division and has participated in India Pakistan War 1971. He has held various instructional appointments at prestigious training institutions like School of Infantry & Tactics, Command and Staff College and  has served as Deputy Commandant at  Pakistan Military Academy. He has served  as Brigade Major in two Infantry Brigades, General Staff Officer-1 and Director  Military Operations (Plans) in Military  Operations Directorate, Director General in Military Intelligence Directorate and has  been the Chief of General Staff of Pakistan Army. Presently he is Commander 10 Corps Rawalpindi.  The General Officer is very highly regarded as a competent and thorough professional who sets and strives for high standards of excellence.
            Lieutenant General Ashfaq Parvez Kayani,  received his education from Military College Jhelum and was commissioned in Baloch Regiment in August  1971. He has held coveted military appointments throughout his career. He is a graduate of Command and Staff College Quetta, Command and General Staff College Fort Leavenworth (USA) and National Defence College Islamabad. The General possesses wide ranging experience in Command, Instructional and Staff appointments. He has commanded an Infantry Battalion, Infantry Brigade, Infantry Division and a Corps. He has been a member of faculty at School of Infantry and Tactics Quetta, Officers Training School Mangla, Command and Staff College Quetta and National Defence College Islamabad.
            Besides being Chief of Staff Corps he has also held the coveted appointment of Director General Military Operations. He last served as Director General Inter Services Intelligence.
            Imbued with the qualities of head and heart, General is perceived to be a purposeful and pragmatic Commander and embodiment of professionalism. Excellence and perfection remain the hallmark of his personality.
            An avid golfer and a keen sportsman, General is also the President of Pakistan Golf Association. He is married and has a son and daughter.
