US Sets Limits

 

Omnibus Bill Withholds $50 Million Until US Confirms Islamabad Is Reinstating Rights

$200 mln cash payments converted into USAID programmes
Use of remaining $250 mln restricted for counter-terrorism and law enforcement activities
Pakistan may not be able to use US military funds to pay for F-16s
Release of $50 mln linked with making concerted efforts against terrorist havens, democratic reforms, freedom of assembly and expression, release of political detainees, ending harassment and detention of journalists, human rights defenders and government critics, and restoring an independent judiciary
Omnibus Bill on Pakistan:
$50 mln may be made available for such purposes after the Secretary of State reports to the Committees on Appropriations that the Government of Pakistan-

(1) is making concerted efforts to prevent Al Qaeda and associated terrorist groups from operating in the territory of Pakistan, including by eliminating terrorist training camps or facilities, arresting members of AI Qaeda and associated terrorist
groups, and countering recruitment efforts;

(2) is making concerted efforts to prevent the Taliban from using the territory of Pakistan as a sanctuary from which to launch attacks within Afghanistan, including by arresting Taliban leaders, stopping cross-border incursions, and countering recruitment efforts; and
(3) is implementing democratic reforms, including -


(A) restoring the Constitution of Pakistan and ensuring freedoms of expression and assembly and other civil liberties guaranteed by the Constitution;


(B) releasing political detainees and allowing inclusive democratic elections;


(C) ending harassment and detention of journalists, human rights defenders and government critics by security and intelligence forces; and


(D) restoring an independent judiciary and ending interference in the judicial process.

(c) Of the funds appropriated by this Act under the heading "Economic Support Fund" for assistance for Pakistan, up to $5,000,000 may be used for administrative expenses of the United States Agency for International Development: Provided, That none of the funds appropriated by this Act may be made available for cash transfer assistance for Pakistan.

Registration Ordinance, 2002:

Ordinance No. LXIV of 2007

 

AN ORDINANCE to amend the Press, Newspapers, News Agencies and Books Registration Ordinance, 2002

 

Whereas it is expedient to amend the Press, Newspapers, News Agencies and Books registration Ordinance, 2002, (XCVIII of 2002), for the purposes hereinafter appearing;

 

And Whereas the National Assembly is not in session and the circumstances exist which render it necessary to take immediate action;

 

Now, Therefore, in exercise of the powers conferred by clause (I) of Article 89 of the Constitution of the Islamic Republic of Pakistan, the President is pleased to make and promulgate the following Ordinance;-

 

1. Short title and commencement. (1) This Ordinance may be called the Press, Newspapers, News Agencies, and Books registration (Amendment) Ordinance, 2007.

 

(2) It shall come into force at once.

 

2. General amendment, Ordinance XCVIII of 2002. In the Press, Newspapers, News Agencies and Books Registration Ordinance, 2002 (XCVIII of 2002), hereinafter referred to as the said Ordinance, after the words "District Coordination Officer", wherever occurring, the words and commas "or, where the District Government has not come into being, the Deputy Commissioner" shall be inserted.

3. Insertion of new section 5A, Ordinance XCVIII of 2002.

 

In the said Ordinance, after section 5, the following new section shall be inserted, namely:-

 

"5A. Restriction on publication of certain material. (1) No printer, publisher or editor shall print or publish in any book, periodical or paper any material which consists of,-

 

(a) photographs or pictures of suicide bombers, terrorists (except as required by law enforcing agencies for purposes of investigation), bodies of victims of terrorist activities, statements and pronouncements of militants and extremist elements and any other thing which may, in any way, promote, aid or abet terrorist activities or terrorism:

 

(b) graphic or printed representation or projection of statements, comments, observations or pronouncement based on sectarianism, ethnicism or racialism;

 

(c) any material, printed or graphic, that defames, brings into ridicule or disrepute the Head of State, or members of the Armed Forces or executive, judicial or legislative organs of the State.

 

(d) any material that is likgly jeopardize or be prejudicial to the ideology of Pakistan or t he sovereignty, integrity or security of Pakistan;

 

(e) any material, photographic or in print, that is likely to incite violence or hatred or create inter-faith disorder or be prejudicial to maintenance of law and order; and

 

(f) any material that is in conflict with the commonly accepted standards of morality and decency and which promotes vulgarity, obscenity, and pornography."

 

4. Amendment of section 19, Ordinance XCVIII of 2002. In t he said ordinance, in section 19, after sub-section (2), for the full stop, at the end, a colon shall be substituted and thereafter the following proviso shall be inserted, namely:-

 

"Provided that in a situation of emergency, pending action under this section, the District Coordination Officer, or as the case may be, the Deputy Commissioner, may suspend the declaration for a period not exceeding thirty days, as deemed appropriate in the circumstances."

 

5. Amendment of section 44, Ordinance XCVIII of 2002. In the said Ordinance, in section 44, for the word "Government" the words "Federal Government in consultation with the Provincial Governments" shall be substituted.

Voluntary Code of Conduct- PEMRA

Voluntary Code of Conduct

 

1.      Scope of the Code:

 

This code of Conduct (hereinafter referred as "the Code") formulated voluntarily by Pakistan Broadcasters Association (hereinafter referred as "the PBA") and all electronic media broadcasters who are members of PBA is aimed at self-regulation of electronic media. The Code will become a part of all licenses issued by Pakistan Electronic Media Regulatory Authority (PEMRA) (hereinafter referred as "the authority"). All the licensees/ permission holders in their individual capacity and PBA, to the extent of its members, hereby undertake that the Code shall be strictly adhered to in letter and spirit. PBA shall assist the authority in every way and manner to ensure strict compliance of the Code by its members.

 

2.     Code of Conduct for Programmes:

 

2.1       we, the media broadcasters being the licensees/ permission holders of PEMRA do understand that the fundamental purpose of news dissemination and current affairs Content in a democracy is to enable people to know what is happening, and to understand affairs that may affect them as members of the community so that they may form their own conclusions. Therefore we do hereby voluntarily undertake that no content shall be aired which contains or is:

            a)         Anything against the territorial integrity and sovereignty of the country and its people, or adversely affects relations with other States;

 

b)                                          any derogatory remarks/  material about any religion or sect or community or uses visual images of words contemptuous of religious sects and ethnic groups or which promotes communal and sectarian biases, hatred or disharmony;

c)                                          anything pornographic and / or obscene as defined by laws in force;

d)                                          denigrating to men or women or children through the depiction in any manner or, in such a way as to have the effect of being derogatory;

e)                                          an abusive comment that, when taken in context, tends to or is likely to expose an individual or a group or class of individuals to hatred or contempt on the basis of race or caste, national, ethnic or linguistic origin, colour or religion or sect, sexual orientation, age or mental or physical disability;

f)                                            any material in violation of copyrights or other related property rights;

g)                                          anything against basic socio cultural norms;

h)                                          promoting, aiding, abetting, glorifying or depicting a heroic picture of terrorism or terrorist activity or any other criminal activity or offence defined in the Pakistan Penal Code or any other law in force;

i)                                            inciting violence or any action prejudicial to maintenance of law and order;

j)                                            anything which is knowingly false or there exist sufficient reasons to believe that the same may be false beyond a reasonable doubt and with malice;

k)                                          anything amounting to contempt of court as defined in Article 204 of the Constitution of Islamic Republic of Pakistan and any other law in force;

l)                                            casting aspersions against the President or security or defense institutions and judiciary of Pakistan;

m)                                        speculations or other assertions which are not based on logic, facts and ground reality and without reference to context;

n)                                          amounting to black mail as defined in Pakistan Penal Code or incrimination of any person, including advantage from such person;

o)                                          any programme including talk shows based on personal bias;

p)                                          anything defamatory as defined in defamation law or relating to an individual's private life unless his or her prior permission has been obtained;

q)                                          compromising the accuracy and objectivity of the news;

r)                                           against sanctity of home, family and marriage;

s)                                           guidance towards committing criminal acts, acts of violence or making/ manufacturing equipments which may used for criminal / terrorist activities.

            Without prejudice to any other restrictions in this regard, while reporting the proceedings of the Parliament or the Provincial Assemblies, such portion of the proceedings as the Chairman or the Speaker may have ordered to be expunged, shall not be broadcast or distributed and every effort shall be made to release a fair account of the proceedings.

            The veracity and authenticity of news and reports broadcast shall be ensured as far as editorially possible.

            Gory images of bloodshed, corpses or human organs, live or recorded shall not be transmitted. Editorial caution must be used while covering tragic incidents such as bomb blasts; war, natural disasters etc. closely focused images and pictures of dead bodies, or severely injured persons shall be avoided.

            Subject to the Code a programme relating to any controversial issues, shall present the point of view of all the stakeholders with equanimity in an objective manner.

 

3.     Broadcasters' Obligations and Responsibilities:

 

3.1              The broadcast media operators, including anchor persons and owners, undertake responsibility to ensure compliance of the code.

 

(a)                Where any offence under PEMRA law has been committed by a person who at the time the offence was committed was in charge of, and was responsible to the company for the conduct of the business of the company as well as the company itself shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly.

(b)               Where the person guilty of an offence under PEMRA law, is a company, corporation of firm, every director, partner and employee of the company, corporation or firm shall, unless he proves that offence was committed without his knowledge, or consent, shall be guilty of the offence and shall be liable to be proceeded against and punished accordingly.

(c)                All efforts must be made by broadcasters and talk show moderators to correct errors of fact at the earliest opportunity and ensure corrections are broadcast to public in the next programme.

(d)               Moderator will be responsible for screening and establishing norms of discussion during the programme.

(e)                Braodcasters and talk show moderators (host / anchor) will ensure that Content of news and current affairs programmes is always presented in a balanced manner. It must be ensured that materials received from foreign countries are not against national interest.

(f)                 Broadcasters and talk show moderators (host / anchor) will ensure that content of news and current affairs programmes are presented with sensitivity in the case of material likely to cause some distress to a substantial number of viewers such as images or interviews with victims of traumatic incidents. Such material should only be used when deemed editorially essential, and if  so only with consent of victim's next of kin.

(g)                Moderator will ensure no discussion on sub-judice matters.

(h)                While addressing or interviewing any person, programme presenters, anchor persons and comperes shall extend proper courtesy and respect to the concerned person in a manner which is fully compatible with our cultural and religious values, social norms and traditions.

 

4.     Compliance Mechanism:

 

4.1              A Committee comprising representatives of Ministry of Information & Broadcasting, PEMRA, Stakeholders and eminent members of Civil Society shall be established to examine and review desirability of content broadcast by the electronic media.

4.2              In case of a violation of the Code, PEMRA may issue a show cause notice to the violator as to why action as per law may not be taken against him.

4.3              PRMRA will take a decision about the suspension of the airing of the content or programme in respect of which a show cause notice has been issued.

4.4              Everyone will be treated as innocent until proved guilty.

4.5              In case the broadcaster fails to render a satisfactory reply the Council of Complaints shall immediately take cognizance of the case and finalize its recommendations  within seven days. Two representatives nominated by the PBA shall be co-opted for these proceedings of the Council of Complaints.

4.6              The action taken by the Authority on the recommendation of the Council of Complaints shall be appeal able in the High Court.

 

5.     Live Uplinking:

 

This is a separate matter already covered under Section 31 of the PEMRA law. The matter of unlinking permission does not require any special treatment or significance because it is already regulated under the aforesaid section of law. Since the Code of Programmes is applicable to all programmes therefore it has to be followed by each broadcaster. The broadcaster has to follow the Code of Conduct in all prgrammes, no matter whether it is live or recorded.

 

5.1.            (a)  EMRA shall issue the necessary certificates and documentation to the broadcast station or distribution service to conduct up-link between a ground transmission facility and a satellite in order to transmit any programme content for broadcast purposes within or outside Pakistan.

(b)               If at any point live converage is likely to air content which violates any law or this Code, the licensee / permission holder or any person operating under it, shall immediately take preemptive measures to prohibit the airing of such content. In this regard all the licensees / permission holders shall incorporate such technological measures within their system which shall provide sufficient time delay in broadcast, to ensure that the content complies with this Code and can be filtered.

6.                 Review:

 

The PBA and PEMRA may review the terms and conditions of the Code in order to incorporate any amendments/ changes incumbent on account of practical issues faced.

 

7.                 Enforcement

 

This code of Conduct will come into force with immediate effect as agreed by PEMRA and PBA members and will apply to all Electronic Media. It will not be applied stringently on entertainment programmes, satire, drama, films and such genres.

 

7.1    Any directive other than that of PEMRA, issued by any Federal/ Provincial functionary / Political Organization shall not be enforceable.

 

8.                 Acceptance:

 

I/ We being the owners /operators / authorized person / representatives of M/s --------------------------------- (a licensee of PEMRA) do hereby certify that I/ we have read, understood and accepted all the provisions of the above Code of Conduct which consists of six pages and hereby undertake to abide by this Code.

PROVISIONAL CONSTITUTION ORDER

 

PROVISIONAL CONSTITUTION ORDER

 In pursuance of the Proclamation of the 3rd day of November, 2007, and in exercise of all powers enabling him in that behalf, the Chief of Army Staff under the Proclamation of Emergency of the 3 rd day of November, 2007, is pleased to make and promulgate the following Order:-

 1.             (1)           This Order may be called the Provisional Constitution Order No. 1       

                                Of 2007.

                                (2)           It extends to the whole of Pakistan

                                (3)           It shall come into force at once.

 

                2.             (1)           Notwithstanding the abeyance of the provisions of the Constitution of the Islamic Republic of Pakistan, hereinafter referred to as the Constitution, Pakistan shall, subject to this Order and any other Order made by the President be governed, as nearly as may be, in accordance with the Constitution:

                                 Provided that the President may, from time to time, by Order amend the Constitution, as is deemed expedient:

                                 Provided further that the Fundamental Rights under Articles 9, 10, 15, 16, 17, 19 and 25 shall remain suspended.

                                 (2)           Notwithstanding any contained in the Proclamation of the 3rd day of November, 2007, or this Order or any other law for the time being in force, all provisions of the Constitution of the Islamic Republic of Pakistan embodying Islamic injunctions including Articles 2, 2A, 31, 203A to 203J, 227 to 231 and 260(3) (a) and (b) shall continue to be in force.

                                 (3)           Subject to clause (1) above and the Oath of Office (Judges) Order, 2007, all courts in existence immediately before the commencement of this order shall continue to function and to exercise their respective powers and jurisdiction:

                                                Provided that the Supreme Court or a High Court and any other court shall not have the power to make any order against the President or the Prime Minister or any person exercising powers or jurisdiction under their authority.

 

                                (4)           All persons who immediately before the commencement of this Order were in office as judges of the Supreme Court, the Federal Shariat Court or a High Court, shall be governed by and be subject to the Oath of Office (Judges) Order, 2007, and such further Orders as the President may pass.

                                (5)           Subject to clause (1) above, the Majlis-e-Shoora (Parliament) and the Provincial Assemblies shall continue to function.

                                (6)           All persons who, immediately before the commencement of this Order, were holding any service, post or office in connection with the affairs of the Federation  or of a Province, including an All Pakistan Service, Service in the Armed Forces and any other Service declared to be a Service of Pakistan by or  under Act of Majlis-e-Shoora (Parliament) or of a Provincial Assembly, or Chief Election Commissioner or Auditor General shall continue in the said service on the same terms and conditions and shall enjoy the same privileges, if any, unless these are changed under Orders of the President.

 

             3.             (1)           No court including the Supreme Court, the Federal Shariat Court, and the High Courts, and any tribunal or other authority shall call or permit to be called in question this Order, the Proclamation of Emergency of the 3 rd day of November, 2007, the Oath of Office (Judges) Order, 2007 or any Order made in pursuance thereof.

                                (2)           No judgment, decree, writ, order or process whatsoever shall be made or issued by any court or tribunal against the President or the Prime Minister or any authority designated by the President.

                4.             (1)           Notwithstanding the abeyance of the provisions of the Constitution, but subject to the Orders of the President, all laws other than the Constitution, all Ordinances, Orders, Rules, Bye-laws, Regulations, Notifications and other legal instruments in force in any part of Pakistan, whether made by the President or the Governor of a Province, shall continue in force until altered, amended or repealed by the President or any authority designated by him.

                5.             (1)           An Ordinance promulgated by the President or by the Governor of a Province shall not be subject to any limitations as to duration prescribed in the Constitution.

 

                                (2)           The provisions of clause (1) shall also apply to an Ordinance issued by the President or by a Governor which was in force immediately before the commencement of the Proclamation of Emergency of the 3 rd day of November, 2007.

PROCLAMATION OF EMERGENCY

             WHEREAS  there is visible ascendancy in the activities of extremists and incidents of terrorist attacks, including suicide bombings, IED explosions, rocket firing and bomb explosions and the banding together of some militant groups have taken such activities to an unprecedented level of violent intensity posing a grave threat to the life and property of the citizens of Pakistan; 

            WHEREAS there has also been a spate of attacks on State infrastructure and on law enforcement agencies; 

            WHEREAS some members of the judiciary are working at cross purposes with the executive and legislature in the fight against terrorism and extremism thereby weakening the Government and the nation's resolve and diluting the efficacy of its actions to control this menace; 

            WHEREAS there has been increasing interference by some members of the judiciary in government policy, adversely affecting economic growth, in particular; 

            WHEREAS constant interference in executive functions, including but not limited to the control of terrorist activity, economic, price controls, downsizing of corporations and urban planning, has weakened the writ of the government; the police force has been completely demoralized and is fast losing its efficacy to fight terrorism and Intelligence Agencies have been thwarted in their activities and prevented from pursuing terrorists;

             WHEREAS some hard core militants, extremists, terrorists and suicide bombers, who were arrested and being investigated were ordered to be released. The persons so released have subsequently been involved in heinous terrorist activities, resulting in loss of human life and property. Militants across the country have, thus, been encouraged while law enforcement agencies subdued; 

            WHEREAS some judges by overstepping the limits of judicial authority have taken over the executive and legislative functions; 

            WHEREAS the Government is committed to the independence of the judiciary and the rule of law and holds the superior judiciary in high esteem, it is nonetheless of paramount importance that the Honorable Judges confine the scope of their activity to the judicial function and not assume charge of administration;

             WHEREAS an important Constitutional institution, the Supreme Judicial Council, has been made entirely irrelevant and non est by a recent order and judges have, thus, made themselves immune from inquiry into their conduct and put themselves beyond accountability; 

            WHEREAS the humiliating treatment meted to government officials by some members of the judiciary on a routine basis during court proceedings has demoralized the civil bureaucracy and senior government functionaries, to avoid being harassed, prefer inaction; 

            WHEREAS the law and order situation in the country as well as the economy have been adversely affected and trichotomy of powers eroded; 

            WHEREAS a situation has thus arisen where the Government of the country cannot be carried on in accordance with the Constitution and as the Constitution provides no solution for this situation. There is no way out except through emergent and extraordinary measures; 

            AND WHEREAS the situation has been reviewed in meetings with the Prime Minister, Governors of all four Provinces, and with Chairman Joint Chiefs of Staff Committee, Chiefs of the Armed Forces, Vice-Chief of Army Staff and Corps Commanders of the Pakistan Army; 

            NOW, THEREFORE,  in pursuance of the deliberations and decisions of the said meetings, I, General Pervez Musharraf, Chief of the Army Staff, proclaim Emergency throughout Pakistan.

 2.         I hereby order and proclaim that the Constitution of the Islamic Republic of Pakistan shall remain in abeyance. 

3.         This Proclamation shall come into force at once.

A small group of US military experts and intelligence officials convened in Washington for a classified war game last year, exploring strategies for securing Pakistan's nuclear arsenal if the country's political institutions and military safeguards began to fall apart.

 

Although US officials express confidence in the current security measures, the more they examine the risks, the more they realize that there are no good answers, said Robert B. Oakley, a former U.S. ambassador to Pakistan.

 

"The bottom line is, it's the nightmare scenario," said retired Marine Col. Gary Anderson, who participated in an earlier exercise that simulated a breakup of Pakistan. "It has loose nukes, hard to find, potentially in the hands of Islamic extremists, and there aren't a lot of good military options."
